PART F -Reasons for Panel Decisi on The i ssue under appeal is whethe r the minist ry's d ecis the period between August 1, 2013 and September 30, 2013 unde was reasonably supported b y t h e ev idence or was a reasonable application o circumst a nc es of the appellant. The relevant legislation is set out in the Child Care Subsidy Regulat Section 4 ( 1 ) To be eligi b le for a c h ild c are subsid y, a parent mus (a) c o mplete an a p plica ti on in the form required by the mi (b) sup ply the mini s ter with the social insurance number (c) su pply t he minister with proof of t h e id e ntity of child car e subsid y. APPEAL# ! I The panel notes the absence of any evidence to support the appellant's assertion that she made repeated attempts to submit her child care subsidy application between August 2013 and October 2013 -the appellant did not provide the ministry or this panel a copy of her child care subsidy applications with a 'received stamp' or a fax machine report confirming successful transmission of the documents, or a proof of delivery from Canada Post. Accordingly, the panel finds that the appellant has not demonstrated that she submitted her application for child care subsidy prior to October 17, 2013, or that the ministry made an administrative error. On the basis of the foregoing, the panel finds that the ministry's decision to deny the appellant child care subsidy for the months of August and September 2013 was reasonably supported by the evidence. The panel therefore confirms the ministry's reconsideration decision. EMT003(10/06/01)
