A Notice of Appeal was received on October 4, 2023 from Jake Hoogland and Hoogland Farms Ltd. This appeal was with respect to the September 6, 2023 decision by the Director, Regulatory Assurance Division South, Alberta Environment and Protected Areas, to refuse Water Act application No. 00480555 for the diversion of water at NE 04-047-26-W4M and NW 03-047-26-W4M in the County of Wetaskiwin, Battle River Basin. The Appellants state their applications for Wetland Licence and Wetland Disturbance Approval DAPP0004277, DAPP0004230 and 00480555, were refused.
In consultation with the parties, the Board held a virtual mediation meeting on January 24, 2024. As a result of the resolution reached at mediation, the appeal was withdrawn by the Appellants in their email and letter of January 29 and February 1, 2024.
Based upon the withdrawal of the appeal, the Board discontinued its proceedings and closed its file on February 1, 2024.
