Notices of Appeal were received on September 15, 2023 from Highfiled Investment Group Inc./Highfield Land Management Inc.  These appeals were with respect to the September 11, 2023 memo from the Director, Alberta Environment and Protected Areas, to File, regarding a Water Act application (DAPP0021802) for drainage alterations and Environmental Protection and Enhancement Act (EPEA) Stormwater Registration application.  The applications relate to the High Plains East Industrial Park in Rocky View County.  The Director refused the Water Act application as the proposed activity did not align with the intent and outcomes of the Wetland Policy.  The EPEA Stormwater Registration application was refused because the Water Act application was rejected.

 

On September 27, 2023, the Board received a request for an abeyance from the Appellants while the Appellants and the Director continued discussions.  The Board granted the request for the abeyance and requested updates be provided on their discussions by October 26, 2023.

 

The Appellants advised on October 27, 2023 that discussions with the Director continued, they resubmitted their revised application, and requested the appeals remain in abeyance until a response was received from the Director.

 

In its email of January 11, 2024, the Appellants withdrew their appeals.  

 

Based upon the withdrawal of the appeals, the Board discontinued its proceedings and closed its file on January 12, 2024.
