A Notice of Appeal and request for a stay were received on June 22, 2020 from Patrick McCarthy.  This appeal was with respect to the June 16, 2020 decision of the Director, Alberta Environment and Protected Areas, to issue Water Act Enforcement Order No. WA-EO-2020/04-SR to Mr. McCarthy for unauthorized activity in a wetland located in the southwest quarter of Section 5, Township 47, Range 20, West of the 4th Meridian, in Camrose County.  The Order required the removal of infill material from the wetland and the restoration of the wetland.

 

In consultation with the parties, the Board held a virtual mediation meeting on October 13, 2020.  

 

In its letter of January 27, 2021 the Board granted a stay of Water Act Enforcement Order No. WA-EO-2020/04-SR as requested by Mr. McCarthy.

Discussions continued in an effort to resolve the appeal and a second virtual mediation meeting was held on April 13, 2022.

 

In its letter of October 18, 2023, the Board acknowledged receipt of a letter from the Director to Mr. McCarthy advising Enforcement No. WA-EO-2020/04-SR was closed.  

 

In an email dated December 14, 2023, Mr. McCarthy withdrew his appeal.

 

Based upon the withdrawal of the appeal, the Board discontinued its proceedings and closed its file on December 15, 2023.
