A Notice of Appeal was received on August 23, 2021 from McNally Contractors (2011) Ltd. with respect to the July 22, 2021 decision of the Director, Alberta Environment and Parks, to cancel Water Act Licence No. dated 1996 04 04 File No. 27439 that was issued to Aggregate Investment Corp. to divert and use the quantities of water prescribed in Interim Licence No. 20976 for industrial purposes (gravel washing) from a well located at SW-15-009-26-W4M.
The Board acknowledged receipt of an email dated August 23, 2021 from the Appellant advising that Aggregate Investment Corp. was bought out by McNally Contractors (2011) Ltd. in 2011, and all licences and permits should have been transferred to McNally Contractors (2011) Ltd.
The Director requested on August 30, 2021, the appeal be held in abeyance to allow for discussions with the Appellant. The Board agreed and requested monthly updates on the discussions be provided by the parties.
On February 24, 2023, the appeal was withdrawn by the Appellant.
Based on the withdrawal of the appeal, the Board discontinued its proceedings and closed its file on February 27, 2023.
