A Notice of Appeal was received on July 12, 2022 from the Ryley Public Advisory Committee with respect to the June 21, 2022 decision of the Director, Alberta Environment and Protected Areas (AEPA), to issue Environmental Protection and Enhancement Act Amending Approval No. 10348-03-01 to Clean Harbors Canada Inc., for the construction, operation and reclamation of the Ryley Industrial Waste Management Facility, consisting of a Class I and Class II industrial landfill and a hazardous waste/recyclable storage and processing facility located in Ryley, Alberta.

 

In consultation with the parties, on August 12, 2022 the Board scheduled a virtual mediation meeting for November 30, 2022.

 

In its letter of September 1, 2022, the Board noted that Clean Harbors Canada Inc. had raised a motion to dismiss the appeal.  The Board set a schedule to receive submissions on the motion to dismiss the appeal.  On October 3, 2022, the Board advised in its letter to the parties, “Since the parties have agreed to participate in mediation, the Board has decided to postpone its review of the submissions and its decision on the motion to dismiss the appeal until after the mediation meeting.”

 

The mediation meeting held on November 30, 2022 was successful and as a result of the resolution, the appeal by the Ryley Public Advisory Committee was withdrawn.  The Board discontinued its proceedings and closed its file on December 1, 2022.  As a result of the successful mediation meeting, the Board did not make a decision on the motion to dismiss the appeal.
