A Notice of Appeal was received by the Board on September 30, 2021 from Lynne Scheideman with respect to the September 16, 2021 decisions of the Director, Alberta Environment and Parks, to issue under the Water Act Approval Nos. 00355134-00-00 and 00475327-00-00, and Licence No. 00355135-00-00 to BURNCO Rock Products Ltd for a sand and gravel pit operation in Parkland County.  The Approvals and Licence were issued for the following purposes:

 

  • Approval No. 00355134-00-00 authorizes placing, constructing, maintaining, dewatering, operating, removing, reclaiming, disturbing works, in or on any land, water or water body; alerting flow, direction of flow or level of water or changing location of water; excavation, disturbance, removal, and placement of soil and other material below the groundwater table; and, maintaining, removing, or disturbing ground, vegetation or other material in or on any land, water or water body at W½ 36-051-03-W5M, SE 36-051-03-W5M, SW 31-051-02-W5M, N½ 26-051-03-W5M, LSD 8-26-051-03-W5M and NW 25-051-03-W5M.

 

         Licence No. 00355135-00-00 authorizes the operation of a works and the diversion of up 120,000 cubic metres of water per year at a maximum rate of 0.32 cubic meters per second for commercial purposes (gravel washing and dust control) at W½ 36-051-03-W5M, SE 36-051-03-W5M, SW 31-051-02-W5M, N½ 26-051-03-W5M, LSD 8-26-051-03-W5M, and, NW 25-051-03-W5M.

 

  • Approval No. 00475327-00-00 authorizes the maintenance, removal and disturbing ground, vegetation or other material in or on any land, water or water body for the purpose of altering, infilling and removing wetlands at SW 01-052-03-W5M and SE 02-052-03-W5M.

 

In consultation with the parties, a mediation meeting was held on May 4, 2022 via Webex.  As a result of the successful mediation, on May 21, 2022, the Appellant confirmed she was withdrawing her appeals.

 

As a result of the withdrawal of the appeals, the Board discontinued its proceedings and closed its files on May 24, 2022.
