ALBERTA ENVIRONMENTAL APPEALS BOARD

Appellants Peter Greenways and Greenways Inc., Operator – Peter Greenways and Greenways Inc., Location – Edmonton, Type of Decision and Date – Discontinuance December 17, 2021

A Notice of Appeal was received on May 30, 2012 from Mr. Peter Greenways and Greenways Inc. with respect to the May 23, 2012 decision of Alberta Environment and Sustainable Resource Development (now Alberta Environment and Parks), to issue Environmental Protection and Enhancement Act Enforcement Order No. EO-2012/01-NR to Mr. Peter Greenways and Greenways Inc. for failing to properly store hazardous wastes and hazardous recyclables at Greenway’s Inc., a former chrome and nickel plating facility located at 52 Street and 73 Avenue (Plan 2149MC, Block 2, Lot 3) in the City of Edmonton.

In consultation with the parties, the Board scheduled a mediation in Edmonton for August 22, 2012.  The parties requested the mediation be cancelled as discussions between the Appellants and the Director were ongoing and progress was being made by the Appellants towards fulfilling the requirements of the Enforcement Order.  On August 16, 2012, the Board cancelled the mediation and requested ongoing status reports on the progress to resolve the appeal.

Discussions between the Appellants and the Director continued.  The Director issued five Amendments to the Order as work was completed by the Appellants.

On December 10, 2021, the Director closed the Order and on December 17, 2021, the Appellants withdrew their appeal.  Based on the withdrawal of the appeal, the Board discontinued its proceedings and closed its file on December 17, 2021.
