A Notice of Appeal was received on June 24, 2013 from William and Christine Trotz, and on July 8, 2013 from Anne Whan, in relation to the June 12, 2013 decision of Alberta Environment and Sustainable Resource Development to issue Water Act Licence No. 00308538-00-00 to Frank and Carol Capron for the operation of a works and diversion of water for a domestic rural community water supply. The Licence allows for the diversion of up to 1,250 cubic metres of water annually at a maximum rate of diversion of 39.3 cubic metres per day from an unnamed aquifer accessed by Well ID No. 1250499 – Well 2 in hydraulic connection to Pelletier Creek, tributary to the Crowsnest River.
In consultation with the parties, a mediation meeting was held on October 8, 2013. As a result of the resolution reached at the mediation, the appeals were withdrawn on the same date. The Board discontinued its proceedings and closed its files in these matters.
