A Notice of Appeal and a request for a stay were received on March 28, 2013 with respect to the March 25, 2013 decision of Alberta Environment and Sustainable Resource Development (AESRD) to issue Environmental Protection and Enhancement Act Environmental Protection Order No. EPO-2013/06-CR to Jerry McInnis for the clean up of a site located at 39015 Highway 2A, in Red Deer County.
The Board began processing the stay, however was advised by the Appellant that the Board did not need to rule on the stay at this time as they were pursuing discussions with AESRD. AESRD issued Amendment No. 1 to the Order on April 17, 2103 extending the deadlines. As discussions did not resolve the appeal, in consultation with the parties, the Board set a mediation meeting for July 22, 2013 and a hearing for October 29 and 30, 2013.
As a result of the resolution reached at the mediation meeting on July 22, 2013, the appeal was withdrawn, the hearing was cancelled, and the Board discontinued its proceedings.
