A Notice of Appeal was received from College Farms Ltd. and Aubern G. Hubbard on March 6, 2012 with respect to the February 12, 2002 decision of Alberta Environment and Sustainable Resource Development, to amend Water Act Licence Nos. 00030071-00-00 and 0035717-00-00 by changing the name of the Licence Holder from Aubern P. Hubbard to Cyril Hubbard and Gerald Hubbard. The Licences are for irrigation purposes for College Farms Ltd. at SW-29-8-22-W4M, in Lethbridge, Alberta.
On March 26, 2012, the Appellants requested the appeal be placed in abeyance while Alberta Environment and Sustainable Resource Development conducted a review of the matters raised in the Notice of Appeal. The Board agreed to the abeyance and requested a status report on the review by May 28, 2012. The matter was further adjourned as Alberta Environment and Sustainable Resource Development continued to review matters raised in the Notice of Appeal. In a letter dated July 17, 2012 the Appellants advised that Licence Amendments had been processed to the satisfaction of the licence holder College Farms Ltd., and as a result, the appellants were withdrawing their appeal. Based upon the withdrawal of the appeal, the Board discontinued its proceedings and closed its file.
