Appellants Penn West Energy, Operator – Penn West Energy, Location – Peace River, Alberta, Type of Appeal – Discontinuance

 

A Notice of Appeal was received on August 16, 2010 from Penn West Energy, with respect to the August 3, 2010 decision of Alberta Environment to cancel Reclamation Certificate No. 246084-00-00, issued to Penn West Petroleum Ltd., for the surface lease at 16-17-081-23-W5M, near Peace River, Alberta.  Alberta Environment advised Penn West that the contaminant audit of the well and remote sump revealed that the site did not meet the requirements of the Alberta Tier 1 Soil and Groundwater Remediation Guidelines as the limit for ethyl benzene was exceeded.

 

Following discussions between Alberta Environment and Penn West, the parties advised the Board they wished to proceed directly to a hearing as mediation would not be successful in resolving the issues.  In consultation with the parties, the Board scheduled a hearing for January 27, 2010.  As the landowner wished to participate in the hearing, the hearing was to be held in Red Deer.  On December 21, 2010 Penn West advised it intended to withdraw their appeal.  The formal notice withdrawing the appeal was received from Penn West on January 4, 2011 and the Board closed its file.
