On March 9, 2010, a Notice of Appeal was received from Larry and Maureen Fisk, and on March 12, 2010 Notices of Appeal were received from Trudy Hill Flesher of the Pigeon Lake Watershed Association, and Mary Ellen Jackson-Herman, with respect to the February 23, 2010 decision of Alberta Environment to issue Water Act Approval No. 00265994-00-00 to Marvin Ostrom authorizing the construction of a shoreline protection works in Pigeon Lake.
The Board held a mediation meeting on June 29, 2010 at Westerose, where an interim agreement was reached. Discussions continued after the mediation and on November 4, 2010 the Board wrote to the Appellant requesting they advise by November 12, 2010 if they wished to reconvene the mediation meeting or were withdrawing their appeal. No response was received and a further letter was sent November 15, 2010 advising the Appellant that as no response was received the Board would assume the appeal was withdrawn and that on November 19, 2010 it would close its file. On November 23, 2010 the Board issued a letter closing the file.
