CERTIFICATION ORDER

                       

            WHEREAS the Canadian Artists and Producers Professional Relations Tribunal issued an order under the Status of the Artist Act dated January 16, 1997, as amended on December 10, 2007 and September 22, 2010, certifying the Canadian Federation of Musicians / Fédération canadienne des musiciens, originally known as the American Federation of Musicians of the United States and Canada;

            AND WHEREAS since April 1, 2013, the Canada Industrial Relations Board is responsible for the administration of Part II of the Status of the Artist Act;

            NOW, THEREFORE, the Canada Industrial Relations Board hereby confirms that the

CANADIAN FEDERATION OF MUSICIANS / FÉDÉRATION CANADIENNE DES MUSICIENS

is certified to represent a sector composed of all independent contractors who are professional artists under the Status of the Artist Act engaged by any producer subject to the Status of the Artist Act to perform the function of instrumental musician, conductor, leader, vocalist or arranger, excluding:

a.     artists within the scope of the certification issued to the Canadian Actors’ Equity Association by the Canadian Artists and Producers Professional Relations Tribunal on April 25, 1996 and subject to the 1996 understanding between Canadian Actors’ Equity Association and the American Federation of Musicians of the United States and Canada, (now known as the Canadian Federation of Musicians/Fédération canadienne des musiciens);

b.    artists within the scope of the certification issued to the ACTRA Performers Guild by the Canadian Artists and Producers Professional Relations Tribunal on June 25, 1996 and subject to the agreement between the ACTRA Performers Guild and the American Federation of Musicians of the United States and Canada (now known as the Canadian Federation of Musicians/Fédération canadienne des musiciens) dated May 14, 1996;

c.     artists within the scope of the certification issued to the Union des Artistes by the Canadian Artists and Producers Professional Relations Tribunal on August 29, 1996;

d.    artists when represented by Local 406 of the American Federation of Musicians of the United States and Canada, known as the Guilde des musiciens et musiciennes du Québec, under the terms of the agreement dated October 23, 1996 between the American Federation of Musicians of the United States and Canada (now known as the Canadian Federation of Musicians/Fédération canadienne des musiciens) and the Guilde des musiciens et musiciennes du Québec.

            AND that, for the purposes of section 28(2) of the Status of the Artist Act, the original date of the certification remains January 16, 1997.
