WHEREAS the Canada Industrial Relations Board (the Board) has received an application pursuant to section 24(1) of the Canada Labour Code (Part IIndustrial Relations) (the Code) from Teamsters Quebec, Local 106, seeking certification as the bargaining agent for a unit of employees of S.L.H. Transport Inc. working exclusively at its facilities located at 3075 Thimens Boulevard, Ville Saint-Laurent, Quebec;

 

AND WHEREAS the Board is of the view that the unit sought by the applicant is appropriate for collective bargaining pursuant to section 27(1) of the Code;

 

AND WHEREAS the Board, in determining the appropriate bargaining unit, has found that part-time employees, given the irregularity of their work, as well as employees who have been absent from work for several years due to disability, should be removed from the list of active employees;

 


AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, the Board has found the applicant to be a trade union within the meaning of the Code and has determined the unit described hereunder to be appropriate for collective bargaining and is satisfied that a majority of the employees of the employer in the unit wish to have the applicant trade union represent them as their bargaining agent.

 

NOW, THEREFORE, it is ordered by the Canada Industrial Relations Board that Teamsters Quebec, Local 106, be, and it is hereby certified to be, the bargaining agent for a unit comprising:

 

all employee drivers of S.L.H. Transport Inc. working at its facilities located at 3075 Thimens Boulevard, Ville Saint-Laurent, Quebec, excluding owner‑operators, warehousemen, office employees, dispatchers and all those automatically excluded under the Canada Labour Code
